Booking Terms

By booking and paying for a trip with Weekend Student Adventures LLC, you agree to and accept the following terms and conditions. This agreement is between you, the participating customer (henceforth referred to as you) and Weekend Student Adventures LLC, 9708 Wharf St, Edmonds, WA 98020 (henceforth referred to as WSA)


1. BOOKING AND PAYMENTS

1.1 To make a booking and guarantee your participation on any WSA Trip, you must agree to the terms and conditions listed below, and provide payment in full. WSA accepts a booking on the understanding that full payment has been collected and held by WSA directly.

1.2 Upon confirmation of your booking and receipt of full payment, subject to availability and at the discretion of WSA, WSA will reserve your seat on the selected trip. It is the responsibility of you, the customer, to check the accuracy of the booking and the dates of travel. No refunds will be issued for customer mistakes made during the booking process including the wrong date booked.

1.3 Upon confirmation of your booking, WSA will issue you a confirmation number and/or e-ticket. It is your responsibility to keep and maintain record of your booking and confirmation for your own records.



2. TRIP DESCRIPTION

2.1 Unless otherwise stated WSA Detours do not include a guide, tour manager or chaperone. The itinerary and activities provided are subject to change, and no substitutions will be made for missed or cancelled activities due to events including but not limited to: acts of God, detention, annoyance, delays, and expenses arising from quarantine, strikes, thefts, pilferage, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, government restrictions or regulations, discrepancies or changes in transit over which it has no control including strikes. Reasonable changes in itinerary may be made where deemed advisable for the comfort and well-being of the participants.

2.2 Depending on the type of trip and itinerary, other products and services including meals, transportation, activities and accommodations will be provided. In the case of intracity transportation, WSA provides public passes for subways, metros, light rails, or buses. In the case of intercity transportation, WSA will provide coach, train, or ferry. In the case of train transportation, second class seats will be provided. If accommodations are provided, they will vary from hostel to hotel to guest house and can include but are not limited to 2,4,6,8, & 10 person rooms. Room preference is subject to availability and is on a first come-first serve basis upon arrival at the hostel or hotel or guest house by you or the WSA group.



3. CONTRACTING PARTIES

3.1 The booking conditions detailed herein contain the entire contract between you and WSA. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.

3.2 Your contract is with Weekend Student Adventures LLC. WSA reserves the right to nominate to you in writing any other company or person to have the benefit of some or all the provisions of this contract, which WSA may then specify, as if you had agreed to the provisions concerned directly with that company or person.

3.3 WSA acts as a booking agent and contracts directly with boats, hostels, hotels, guest houses, and other service providers. All bookings with carriers and other service providers are subject to their terms and conditions and limitations of liability. It is important to note that some of these limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. WSA cannot accept any responsibility for any loss or damage as a result of such actions or as a result of any act of error or omission of any such third parties.

3.4 Many accommodation arrangements provided by WSA are contracted to third party providers. They are subject to the terms and conditions, and limitations of liability, imposed by the provider. All arrangements are made independently of WSA, regardless of the booking of such arrangements by WSA.



4. PARTICIPANT RESPONSIBILITIES

4.1 It is your responsibility to make sure you have a valid passport, and all necessary visas, permits or certificates on your person for your selected trip. WSA is not liable for any problems, delays or denied entry in the event you are not in possession of valid travel documents.

4.2 You agree to comply with the authority of the WSA tour manager/travel advisor, and the laws and regulations of the countries visited, including customs and foreign exchange restrictions. If you do not comply with said reservations, you will be asked by the WSA tour manager/travel advisor to leave the trip. You are not eligible for refunds under such circumstances.

4.3 There may be times when the WSA tour manager must make a decision for the safety and/or best interests of the group. It is a condition of booking that you comply with the authority and decisions of the WSA tour manager. If you do not comply, or if in the opinion of the WSA tour manager, you are not compatible with the general enjoyment of the group or the smooth operation of the trip, WSA reserves the right to refuse to allow you to continue with the trip. You agree that WSA has the exclusive right to dispel you from a trip at anytime, without any claims or complaints by you against WSA. In such a case WSA will not be liable for any refund, compensation, or additional costs incurred by you.

4.4 It is your responsibility to meet the transportation or tour manager provided by WSA at the correct time and location, as specified in your trip details and itinerary. In the event you miss a planned departure, any extra travel costs incurred are paid by you. It is your responsibility to check in with the WSA tour manager 15 minutes prior to the specified departure time. Due to the nature of the services provided, WSA will not be liable if any service departs or arrives later than the specified time, even if as a result you miss a connecting service.

4.5 WSA may not be held responsible for your personal belongings at any time including while in the arranged accommodations as well as out in the visited city. It is your responsibility to look after your belongings. WSA cannot be held responsible for loss, theft or damage to any of your personal belongings, regardless of the circumstances.

4.6 The products offered by WSA are travel packages consisting of tour manager services and other accommodations, meals and activities as specified by the itinerary. Due to the consistent needs of the group as a whole, WSA tour managers cannot offer constant special attention or assistance should you have any physical disability requiring such attention.

4.7 You agree that WSA may take photographs and films while you are participating on a WSA trip. You agree that these images my be used for marketing and/or promotional purposes by WSA. These images may be used in, but are not limited to, brochures, pamphlets, websites, print media and promotional videos. These images may be used for publicity and advertising without WSA obtaining further consent or payment for the use of the images.

4.8 WSA does not in any way condone or encourage the consumption of alcoholic beverages. While WSA tours operate in countries where the drinking age is less than 21, WSA cannot be held responsible for those under 21 who decide to consume alcoholic beverages.

4.9 All persons (including those under 21) who choose to consumer alcoholic beverages do so at their own volition, risk and at their responsibility. WSA will not be held responsible for any scenarios that result from the choice to consume alcoholic beverages.

4.10 Those who do drink alcohol, regardless of age, do so at their own risk and accept full responsibility for their actions as the result of such activity. WSA is not liable or responsible for any results, consequences, damages, fines, etc. arising out of such activity, including but not limited to, personal injury or death, property damage, imprisonment, fines, expulsion from tours, or any other negative consequences. WSA strongly encourages tour members to always act responsibly and in compliance with all local and federal laws and guidelines.

4.11 Prescribed medication clause. Every WSA tour member or client must continue to take all physician-prescribed medication while on a WSA tour. Any costs arising from situations or emergencies that result from complications of not taking prescribed medication are the sole responsibility of that tour member, and WSA will not be liable. In addition, that tour member will be held responsible for costs to continued business of WSA arising from emergencies relating to this issue.

4.12 All WSA participants must be over the age of 18 at the time of booking.



5. LOCAL TRIPS AND EXCURSIONS

5.1 You may have the opportunity to purchase from WSA local trips and/or excursions at your chosen destination. Trips and excursions are not included in the price of your trip (unless otherwise stated). You are responsible for any additional costs.

5.2 Any trips and excursions purchased by you are run by local operators and you will be subject to their terms and conditions.

5.3 Local trips and excursions purchased through WSA are non-refundable and non-transferable. It is your responsibility to meet the trip at the designated departure point and time.

5.4 It is your responsibility to keep track of any local trip and excursion vouchers or tickets issued to you by WSA. Lost vouchers or tickets cannot be replaced.



6. INSURANCE

6.1 There is no travel, travel accident, accident, or medical insurance included in the cost of any WSA trip or package, ticket, or product.

6.2 WSA strongly recommends that you are covered by a comprehensive insurance policy which includes: personal accident, medical expenses, emergency repatriation, personal baggage, money and public liability, and any other international insurance required. By entering into this agreement, you affirm that you have been advised by WSA to purchase and be covered by your own international emergency medical insurance that covers all segments of your travels.



7. WEATHER, ENVIRONMENT AND POLITICAL CONDITIONS

7.1 WSA may not be held responsible for any delay, deviation, or cancellation due to weather conditions. No trip may be cancelled or changed by you at anytime on the basis of weather conditions.

7.2 WSA may not be held responsible for delays due to labor disputes (including strikes that are previously announced or spontaneous), border problems or other political or economic factors.

7.3 WSA may not be held responsible for delays due to mechanical failure, or other issues that may arise and are outside our control.

7.4 WSA may not be held responsible for delays or cancellations due to hostile political environments or other issues that may arise due to this and are outside our control. WSA at any time may deem it unsafe to run tours in various destinations due to political unrest and may not be held responsible for these cancellations.


8. CANCELLATION/CHANGES

8.1 Any discounted fares, promotion fares, and package deals are non-refundable. This applies to the following:

a. All promotional rates for trips are non-refundable.

8.2 Promotional trips as prizes are non-transferable nor do they carry any cash value.

8.3 Cancellation/change of a booking by you must be made in writing to WSA prior to the day of departure and may incur additional charge. The following cancellation policies apply:

a. 30 or more days prior to departure 100% refund minus any costs incurred for the booking by WSA on behalf of the customer

b. 25-29 days prior to departure 50% refund minus any costs incurred for the booking by WSA on behalf of the customer

c. Less than 25 days prior to departure no refund. Any booking or payment made with less than 25 days remaining before the trip is subject to the same conditions.

d. As stated in 8.1(a), trips purchased during promotional periods and/or at promotional fairs are non-refundable.

8.5 No refunds will be made in respect of any unused portion of a ticket or partially completed trip.

8.6 Although unlikely, trips may be cancelled/changed by WSA due to lack of the minimum number of participants or other unforeseen circumstances. WSA reserves the right to cancel/change trips up to but not less than 12 hours in advance. In the event a trip is cancelled/changed, you will be notified by email or phone. In the event of a cancellation by WSA, you will receive a full refund for the amount paid.



9. GENERAL WAIVER OF LIABILITY

I agree and understand that I hold WSA, its officers, partners, employees and agents harmless from all liability and claims arising out of or in connection with my participation in this purchased trip including but not limited to the dangers involved with traveling and adventure activities. I hereby release and discharge WSA and its officers, partners, employees and agents from all liability arising out of or in connection with the purchased trip. I understand that my participation in the purchased trip and in any of its activities--organized or not--is voluntary, is not required and is at will.



10. MANDATORY ARBITRATION

Any dispute or difference arising out of or in connection with this contract shall be determined by the appointment of a single arbitrator selected by WSA, after either party has given to the other a written request to concur in the appointment of an arbitrator.
